important information
Payments & deposits:
total Fee is the amount outlined on the agreed invoice.
Deposit is 50% of the total which is due at the time of booking to reserve the date. This deposit is non-refundable.
The remaining balance is (deposit-total fee) which is the remaining 50% after the deposit which is due up to 24hrs before 00:01 of the day of the shoot.
Remaining balance must be paid for shoot to take place.
Unless arranged between both parties, not paying the remaining balance on time means the photographer in this contract will not arrive at shoot.
Cancellations & Rescheduling:
If the Client cancels the agreement more than 3 days before the event, any payment made except the deposit will be refunded.
The client can cancel the shoot at any time before the shoot however, a refund does not have to be given to client. The photographer holds all rights to retain payment in this case.
Rescheduling requests are subject to photographer availability. In this case a new deposit will not have to be paid.
If the client requires the shoot to be rescheduled on the day of the shoot, a new deposit will need to be paid as a result of the late notice.
In case of extreme weather conditions, illness, or unforeseen circumstances, I reserve the right to reschedule the shoot.
Photographer’s Obligations
The Photographer will provide the Services in a professional manner, using equipment of professional standard.
The Photographer will deliver the agreed-upon deliverables in the format specified in Section 1, within the number weeks after the event/session that is outlined on invoice, unless otherwise agreed upon.
The Photographer will take reasonable steps to back up and safeguard the images but is not liable for loss due to circumstances beyond their control.
It is not the photographer’s obligation to help with locations for the shoot. The photographer can help when required but the clients may need to find locations for the shoot.
Client’s Obligations
The Client agrees to cooperate and provide necessary information required for the Photographer to perform the Services.
The Client ensures that access and permission are granted for shooting at the chosen venue/location.
The Client will notify the Photographer of any specific shots or moments they wish to be captured prior to the event/session.
Clients are responsible for arriving on time to their session. If you are late, the shoot duration will not be extended.
film shoots
film can be done with any package other than track days currently.
the film shoots cost the same however additional fees are required to cover the cost of the film and development of the film.
if the roll/rolls of film are not up to standard, the client/clients can schedule another shoot where the original total fee will still need to be paid however, the cost of a new shoot, the cost of development and cost of film for the rescheduled shoot will not need to be paid.
currently kodak portra 400 costs around £20 a roll and development costs around £16 for development and tiff (high quality) scans. Cost may change based on prices from other companies.
per roll at an additional cost to client of around £36 + 1st class postage extra on top of shoot type. “Cost of 1st class postage” will vary based on time of posting.
Copyright & Usage:
All photographs remain the copyright of the Photographer.
The Photographer grants the Client a non-exclusive license to use the images for personal use only. allowing the client to print, share, and use images for personal purposes only.
The Client may not sell, license, redistribute or publish the images to a third party for commercial or personal use without the Photographer’s written consent, unless otherwise agreed in writing.
The Photographer retains the right to use the images for portfolio, website, social media, marketing, and promotional purposes, unless the Client requests otherwise in writing prior to the event/session.
The client may use these photos on social media however; the photographer must be tagged/mentioned when the photo is used.
The photos must not be shared by the client to anyone without written permission from the photographer.
If the vehicle being photographed changes ownership the photos must stay with the client and cannot be sold/given with the car.
Commercial use (for businesses, advertising, or promotional purposes) requires a separate licensing agreement. Please discuss this before booking.
Model Release
The Client grants permission to the Photographer and their legal representatives to use and publish the photographs for any lawful purpose, including advertising and promotion, unless the Client requests otherwise in writing. If minors are included in the photographs, the Client affirms that they are the parent or legal guardian and grant permission as such.
The photographer has the right to gather additional photos, videos and sound clips from the shoot for use on the photographer’s social media, advertisement, website and portfolio.
Vehicle Responsibility
At not point will the photographer operate or move the vehicle unless authorized by the owner (according to V5 document) in writing.
Client is responsible for ensuring the vehicle is clean, presentable, and in working order at time of shoot.
The photographer is not responsible for any damage to the vehicle during the shoot.
Artistic Style and Editing
The Client acknowledges that they are familiar with the Photographer’s portfolio and style.
The Photographer retains creative control over the editing and style of the final images.
Requests for significant retouching or alterations may incur additional fees, to be agreed upon in advance.
The client may not alter, adjust, change, edit or crop the delivered photos in anyway.
The client may not add filters, make changes to the photos in any way or use AI tools (such as but not limited to expansion, object removal or additions, etc).
Rolling shots waiver
If rolling (motion) shots are requested by the client, the following conditions apply:
The client must provide a designated driver to operate the subject vehicle(s).
All rolling shots must be taken on private property or low traffic public roads and all participants must follow traffic laws.
Any high speed driving or illegal activity is strictly prohibited and the photographer takes no responsibilities for any consequences that may come from that behaviour.
The client understands and agrees that rolling shots involves certain inherent risks, including but not limited to accidents, road hazards, and environmental conditions. The client assumes full responsibility for any risk of damage or injury that may occur.
The client agrees to hold harmless and indemnify the photographer against any and all claims, liability, damages, or expenses arising from or related to rolling shots, including third party actions or incidents.
Limitation of Liability
In the unlikely event of total photographic failure, loss of images, or cancellation of this Agreement by the Photographer, liability is limited to the return of all payments received from the Client.
The Photographer is not liable for any indirect, incidental, or consequential damages arising from the services provided.
Photographer is not liable for delays caused by traffic, weather or vehicle issues and may require additional compensation made to the photographer from the client in the form of additional payment.
Deliverables and Delivery
Images and deliverables will be provided in a private/password protected gallery that clients can download the images from in high quality/resolution.
Images and deliverables will be delivered within the time frame selected by client, unless otherwise agreed upon in writing or due to extenuating circumstances (which include but are not limited to family loss, equipment failures, etc)
Images will remain downloadable for 30 days (from delivery date), after that all images will be removed from the gallery and an additional fee may incur to have them reuploaded.
At no point will the photographer share any RAW or unedited files with the client.
Confidentiality
Both Parties agree to keep the terms of this Agreement and any proprietary or confidential information obtained during the performance of the Services confidential, unless otherwise required by law.
extras
this is not my main job. i have a full time job which means i have limited avaliability for shoots etc.
a contract must be signed before shoot begins.
travel information
if the shoot location is within a 30 mile radius of norwich then no additional fees are required.
if the shoot location is more than 30 miles from norwich centre then a fee of 5p per mile could be charged to accommodate for fuel usage.
